The range and sale of products on our website ("whitebirdjewellery.com") are governed by these Terms and Conditions. We advise you to read them carefully. Items purchased on whitebirdjewellery.com are sold directly by SAS LE BIJOU INDEPENDANT, 38 rue du Mont-Thabor, 75001 Paris.
Only individual customers and "end user" companies buying for purposes other than resale may place orders on the whitebirdjewellery.com site. The resale or distribution of items purchased on Whitebirdjewellery.com is strictly prohibited. Furthermore, each time you place an order on Whitebirdjewellery.com, you will be asked to confirm your acceptance of the Terms and Conditions in effect at the time of your order. Given the sales policy described below, WHITEbIRD reserves the right not to act upon orders placed by anyone other than an "end buyer", or orders that do not comply with its sales policy as defined herein. Article 1 – Availability
Our products are sold subject to availability. When placing your order, ensure that the number, size and price of each item are mentioned correctly on your purchase order. When a product is no longer available, it will be marked "OUT OF STOCK". In this case, you can contact us in order to be the first informed when it becomes available again on the site or in the store.
Article 2 – Orders
When placing your first order, you must create an online account with your personal contact information and keep this up to date. The contract is deemed to have been entered into once WHITEbIRD receives the electronic order form and once the order details have been verified. Before submitting the order form to purchase a product, you are asked to read these Terms and Conditions carefully. Electronically submitting the order form signifies your unconditional acceptance and agreement to abide by these Terms and Conditions in dealing with WHITEbIRD. If you do not accept the terms laid out in these Terms and Conditions, please do not submit your order form for the purchase of items on whitebirdjewellery.com.
Article 3 – Pre-orders
Once you have placed a pre-order, we will not be able to make changes to the order. This includes size changes, quantities, etc. As soon as the preorder has been placed, it cannot be canceled unless the shipment is unavoidably delayed.
As per Article L121-20-2 of the French Consumer Code, the seven-days right of withdrawal cannot be exercised for a preorder because the jewel is especially ordered and created following the client’s request.
If you preorder jewels, you will be required to the entire amount and the shipping fees and taxes at the time you place your order.
Once the jewel is delivered in our office, you will receive an email notification from us to confirm your delivery address. We will then ship your jewel and send you the tracking information.
Please be aware that because of the “pre-sale” nature of such transactions, you should expect a wait period that will vary according to the designer’s stock. The estimated delivery window will be noted on the jewel page.
Article 4 – Prices and payment
The prices of our products are given in euros/dollars/pounds, inclusive of all taxes. Prices exclude delivery charges. WHITEbIRD reserves the right to change prices at any time, but products will be billed according to the prices in effect at the time the order is processed, subject to availability. After clicking on "order" you may choose one of the following payment options :

- Payment by wire transfer
- Payment by Alma, in 2 or 3 installments
Article 5 – Confirmation
The information recorded by whitebirdjewellery.com when an order is confirmed constitutes proof of all transactions between whitebirdjewellery.com and its customers. The information recorded by the payment system constitutes proof of financial transactions.
Article 6 – Delivery
Products purchased on whitebirdjewellery.com are shipped according to the terms described under ‘’Delivery’’, found at the bottom of every page of the site.
For safety reasons, WHITEbIRD will not process orders to any post office boxes or French CEDEX addresses.
In order for delivery to be assured, you agree to provide your full and accurate address when placing your order, including any additional information deemed necessary, such as your building number, floor or door access code when applicable. If you choose ‘’Collect-in-Store’’, we kindly ask you to present yourself at our boutique at 38, rue Mont Thabor in the 1st arrondissement of Paris. Please bring a valid ID. You may collect your items 3 hours after having placed your order and within the 10 following days. The shop’s opening hours are: Monday: from 12.30 to 7.30pm and Tuesday to Saturday: from 11.30 to 7.30pm. Please note that orders placed on a Sunday can be collected in the store at the earliest on the following Monday at 2pm.

For orders exceeding 2000€, shipping is complimentary and packages are sent with FedEx.
- Customs: For deliveries to countries outside of Europe or Overseas French Territories, the French VAT (20%) will be automatically deducted from your invoice.
Customs duties, local taxes, import duties or taxes of State may be due. The costs and taxes related to the delivery of an item are not billed by, nor part of Whitebird Jewellery's responsibility, but are dependent on and borne by you.
- Insurance: All of our deliveries are insured no matter the transport company or the value of the order.
- Delivery tracking: We personally track all of our shipments. Additionally, we will provide you with a tracking number for your parcel as soon as it leaves the store, allowing you to track it yourself at any time.
- Delivery problems: Any delivery failure or delay of more than eight (8) working days should be reported to our Customer Service as soon as possible (+33 (0)1 42 60 52 39) or contact@whitebirdjewellery.com). We cannot act on any claims submitted more than fifteen (15) calendar days after the date your order was confirmed. You must check the goods carefully upon receipt. If you notice any errors or problems (opened package, damaged goods etc.), you must indicate this on the delivery slip and contact our Customer Service by Email or phone. If the products do not comply with your order or if you are not fully satisfied with your purchase, you may exchange or return the items and request a refund under the terms stipulated in the "RETURNS/EXCHANGES" section below.
Article 7 – Returns / Exchanges
WHITEbIRD is committed to providing high quality products. Nonetheless, if you are not fully satisfied with the purchased item, WHITEbIRD will exchange it or provide you with a refund.
If you wish to return items, the return shipping costs will be at your charge. However, in case of an exchange, we offer free shipping on your new order.
In accordance with Articles L.121-20 et seq. of the Consumer Code, purchased items may be returned to us within maximum 14 days of receiving the goods. In the case of a refund, you will be credited in the way that matches the original payment method used. Please note that refunds may take up to 15 days to complete following the reception of your return. WHITEbIRD reserves the right to deduct any additional bank charges and commissions connected with the method of payment.
Returned jewellery must arrive unworn, in pristine condition, with the security tag attached and in their original packaging. Damaged or incomplete items are not subject to an exchange or a refund, and will be returned to you as is, at your expense.
Customized/engraved/resized jewels can't be neither exchanged nor refunded.

The products sold on this site comply with current French legislation. It is your responsibility to check with your country's authorities whether you are allowed to import or use the products or services that you plan to order. Photographs and text reproduced to illustrate the products for sale are not contractual. Consequently, whitebirdjewellery.com cannot be held not liable for any errors concerning photographs or text. Whitebirdjewellery.com cannot be held liable for breach of contract in the event that the product is out of stock or unavailable, or in the event of force majeure, disruption, flood, fire or strike, particularly of postal, transport or communication services. Whitebirdjewellery.com shall not be liable for any direct or indirect result of these risks.
Article 10 – Governing law - Disputes/Litigation
This contract is subject to French law. It is written in French and English and if there is any discrepancy between the two, the French shall prevail. In the event of a legal dispute, only French courts have jurisdiction.
In the event of a dispute with WHITEbIRD online or in a store, it is possible to have recourse free of charge to a consumer mediator with a view to amicably resolving the dispute.

Whitebirdjewellery.com agrees not to disclose to third parties the information you provide. This information will remain confidential. It is used exclusively by our own services for the purposes of processing your order, customizing and enhancing our communication and products for whitebirdjewellery.com customers, particularly through whitebirdjewellery.com newsletters to which you may subscribe, and of customizing the website to suit you better. Consequent to and in accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify, and oppose your personal information. Article 12 – Warranty
Consumers have a period of two years from the date of delivery of the goods in which to invoke the legal warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity, and not the date of its appearance.
Where the contract for the sale of goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty applies to this digital content or digital service throughout the period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or service, and not the date of its appearance.
The legal warranty of conformity obliges the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal warranty of conformity entitles the consumer to repair or replacement of the good within thirty days of his request, free of charge and without any major inconvenience for him.
If the good is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer asks for the good to be repaired, but the seller requires it to be replaced, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.
The consumer may obtain a reduction in the purchase price by keeping the good, or terminate the contract by obtaining a full refund against return of the good, if :
1° The professional refuses to repair or replace the good;
2° The goods are repaired or replaced after a period of thirty days;
3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming good, or if he bears the cost of installing the repaired or replacement good;
4° The non-conformity of the good persists despite the seller's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract when the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the consumer is not obliged to request repair or replacement of the goods beforehand.
The consumer is not entitled to have the sale rescinded if the lack of conformity is minor.
Any period of immobilization of the good for the purpose of repair or replacement suspends the remaining warranty period until delivery of the reconditioned good.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
Any seller who obstructs the implementation of the legal warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales (article L. 241-5 of the French Consumer Code).
Consumers are also covered by the legal warranty for hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the good is kept, or to a full refund in exchange for the return of the good.
